1. Introduction

Welcome to Seeed. These Terms of Service ("Terms") govern your access to and use of the Seeed app, its services, and website ("Service"). Please read these Terms carefully.

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Account Creation and Usage

To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate and complete information when creating your account and to update your information to keep it accurate and complete.

3. Credits and Payments

Our Service operates on a credit-based system. Credits are required to generate images, upscale images, and train custom models.

All purchases are final and non-refundable unless required by law. Credits refresh monthly and any unused credits from the previous month will be reset at the beginning of each new billing cycle.

We reserve the right to change our pricing and credit system at any time. Any changes will be communicated to users in advance.

All payments are processed securely through Stripe, a trusted payment processor with industry-standard security measures in place to protect your financial information.

4. Intellectual Property Rights

You retain rights to the images you generate using our Service.

We do not use any of your uploaded or generated images for internal training purposes. Your images remain private and are only used for the specific services you request.

When an image is deleted from your account, it is permanently deleted from our systems and cannot be recovered.

All models used in Seeed can be used commercially. Additionally, all images generated by Seeed can be used commercially by the user who created them.

You agree not to use our Service to generate content that infringes on others' intellectual property rights.

5. Acceptable Use Policy

You agree not to use the Service to:

• • Impersonate others or provide false information
• • Attempt to gain unauthorized access to the Service or its related systems
• • Interfere with or disrupt the integrity or performance of the Service

We reserve the right to terminate or suspend accounts that violate these policies.

6. Limitation of Liability

The Service is provided "as is" without warranties of any kind, either express or implied.

We are not liable for any damages arising from your use of the Service, including but not limited to direct, indirect, incidental, consequential, or punitive damages.

7. AI Technology Disclaimer

Our Service utilizes artificial intelligence technology for image generation, which is inherently unpredictable and may produce unexpected or undesired results.

We do not guarantee the quality, accuracy, or appropriateness of any AI-generated content. Generated images may not match your expectations or intended outcomes.

We are not responsible for any poor-quality outputs, inappropriate content, or results that do not meet your expectations. Users acknowledge that AI-generated content can be inconsistent and unpredictable in nature.

By using our AI services, you accept full responsibility for reviewing and evaluating all generated content before any use or distribution.

8. Third-Party Services and Technical Issues

Our Service relies on various third-party API services, cloud technologies, and external infrastructure providers to deliver our features and functionality.

We do not guarantee uninterrupted service availability. Technical issues, downtimes, maintenance, or outages may occur due to factors beyond our control, including but not limited to third-party service disruptions, network issues, or infrastructure problems.

We are not responsible for any service interruptions, delays, or technical problems caused by third-party providers, external APIs, cloud services, or other technology partners we depend upon.

While we strive to provide reliable service, users acknowledge that technical issues are inherent to cloud-based and API-dependent services, and we cannot be held liable for any inconvenience or losses resulting from such issues.

9. Changes to Terms

We may modify these Terms at any time. We will provide notice of significant changes through the Service or by other means. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

10. Termination

You may cancel your subscription at any time through your account settings or by contacting our support team. Cancellation will take effect at the end of your current billing period.

We reserve the right to suspend or terminate your access to the Service at any time for any reason without notice.

Upon termination, your right to use the Service will immediately cease. All provisions of the Terms that by their nature should survive termination shall survive.
